O presente artigo visa apresentar algumas das regras normativas do código monástico budista relacionadas ao ato de esmolar alimentos pelos renunciantes de ambos os sexos das comunidades budistas, Saṃgha. O ato de esmolar alimentos, assim como todo o conjunto de características comportamentais e morais relacionado aos praticantes monásticos, se tornou um importante elemento que proporcionou identidade para as Saṃghas do Buda, uma vez que benfeitores – que moravam nas cidades e vilas ao entorno das comunidades – acabavam por reconhecer monges, (...) bhikṣus e monjas, bhikṣunīs distinguindo das demais religiosidades e comunidades da Índia Antiga. Essas regras instituídas pelo Buda histórico, e preservadas pelas comunidades, evidenciam o grande cuidado no tocante à nutrição dos praticantes, especialmente em relação ao como e o que se alimentar, a higiene pessoal, bem como o comportamento dos bhikṣus e das bhikṣunīs com todo esse processo. O objetivo da atenção à alimentação não era outro que proporcionar condições adequadas para o desenvolvimento dos praticantes em relação aos estudos e à meditação. (shrink)

In “Practical Knowledge of Language”, C.-h. Tsai criticizes the arguments in “Swimming and Speaking Spanish” (this issue, pp. 331–341), on the grounds that its account of knowledge of language as knowledge-how is mistaken. In its place, he proposes an alternative account in terms of Russell’s concept “knowledge-by-acquaintance”. In this paper, I show that this account succeeds neither in displacing the account in Swimming and Speaking Spanish nor in addressing Tsai’s main concern: solving the “delivery problem”.

One of the main challenges in the philosophy of language is determining the form of knowledge of the rules of language. Michael Dummett has put forth the view that knowledge of the rules of language is a kind of implicit knowledge; some philosophers have mistakenly conceived of this type of knowledge as a kind of knowledge-that . In a recent paper in this journal, Patricia Hanna argues against Dummett’s knowledge-that view and proposes instead a knowledge-how view in which knowledge (...) of the rules of language is a kind of practical knowledge, like an agent’s non-propositional knowledge of counting. In this paper I argue, first, that Hanna misunderstands Dummett’s conception of knowledge of linguistic rules, and, second, that Dummett’s considerations of practical knowledge of language pose a problem for Hanna’s knowledge-how view. At the end of the paper, I briefly sketch an account of practical knowledge of language that meets the requirements set by Dummett. (shrink)

Banded geckos (Coleonyx variegatus) were trained, at the rate of five daily trials, on eight intradimensional spatial shifts to a criterion of 80% correct per reversal. In contrast to several previously reported failures to obtain reversal learning, Coleonyx demonstrated significant improvement on both errors and trials to criterion. Their reversal performance compares favorably with that of birds and mammals and a common index of reversal ability, the mean total error, did not differentiate between taxa.

People often make less risky decisions for themselves than others. We examined how people allocated risks (i.e., determining the ratio of uncertain outcomes to certain outcomes) between themselves and others. We also investigated gain (vs. loss) domain and social value orientation as predictors of risk allocations. The results of three experiments demonstrated that participants were more likely to share their risks equally between themselves and others than distribute risk unequally. In the gain (vs. loss) domain, participants allocated fewer risks to (...) themselves and more risks to the other person for unequal risk allocations. Compared to proselfs, prosocials were more likely to allocate risks equally. We also found stronger domain effects on unequal risk allocations for proselfs than for prosocials. Therefore, our findings clarify the effects of risk distribution, domain, and social value orientation on interpersonal allocation decisions and highlight equal risk distribution between oneself and others. This paper examines whether the modern bioethical principles of respect for autonomy, beneficence, non-maleficence, and justice proposed by Beauchamp and Childress are existent in, compatible with, or acceptable to the leading Chinese moral philosophy—the ethics of Confucius. The author concludes that the moral values which the four prima facie principles uphold are expressly identifiable in Confucius’ teachings. However, Confucius’ emphasis on the filial piety, family values, the “love of gradation”, altruism of people, and the “role specified relation oriented ethics” will (...) inevitably influence the “specification” and application of these bioethical principles and hence tend to grant “beneficence” a favourable position that diminishes the respect for individual rights and autonomy. In contrast, the centrality of respect for autonomy and its stance of “first among equals” are more and more stressed in Western liberal viewpoints. Nevertheless, if the Confucian “doctrine of Mean” and a balanced “two dimensional personhood” approach are properly employed, this will require both theorists and clinicians, who are facing medical ethical dilemmas, of searching to attain due mean out of competing moral principles thus preventing “giving beneficence a priority” or “asserting autonomy must triumph”. Based on key passages in The Analects, I develop a Confucian account of agency: more precisely, an account of the relation between agent and deed (action). The Confucian view is contrasted with "standard" causal accounts of action (e.g., Davidson, Searle), which hold that what makes an event an action is that it is intended. According to the Confucian account, the defining mark of action is not the causal involvement of a (prior) intention, but instead the expressive relation between agent and (...) action. What's distinctive about an action is that it is expressive of who the agent is; the action expresses one's character or self. For the Confucians, what one really intends (the content of one's intention) is not a prior state to the action, but is rather determined or settled by the action as it is completed. I then explore the implications of the Confucian account for our understanding of three moral-psychological phenomena: weakness of will, self-deception, and moral regret. (shrink)

According to the universality thesis, the epistemic properties referred to by the English epistemic verb “know” contained in the expressions of the form “S knows that p” or “S knows how to φ‎” are shared by the translations of the epistemic verb in all other languages such as Chinese, Japanese, Korean, Russian, and so on. Some doubt that there is reason to think the universality thesis is true because little or nothing is shown about the meanings and uses of the (...) epistemic terms in languages other than English. Critics of the universality thesis find counterevidence to the thesis; that is, the evidence demonstrates that translations of the epistemic verb “know” are used differently in some languages from the way “know” is used in English. In this paper, I propose a virtue-theoretic approach to semantics, according to which the study of linguistic competence in particular, and the study of meaning and language in general, should focus on a speaker's interpretative virtues, such as charity and interpretability, rather than the speaker's knowledge of rules. The first part of the paper proffers an argument for shifting to virtue semantics, and the second part outlines the nature of such virtue semantics.

Abstract:We discuss the role that transnational corporations (TNCs) should play in developing global governance, creating a framework of rules and regulations for the global economy. The central issue is whether TNCs should provide global rules and guarantee individual citizenship rights, or instead focus on maximizing profits. First, we describe the problems arising from the globalization process that affect the relationship between public rules and private firms. Next we consider the position of economic and management theories in relation to the social (...) responsibility of the firm. We argue that instrumental stakeholder theory and business and society research can only partially solve the global governance issue, and that more recent concepts of corporate citizenship and republican business ethics deliver theoretically and practically helpful, fresh insights. This important book proposes a new account of the nature of language, founded upon an original interpretation of Wittgenstein. The authors deny the existence of a direct referential relationship between words and things. Rather, the link between language and world is a two-stage one, in which meaning is used and in which a natural language should be understood as fundamentally a collection of socially devised and maintained practices. Arguing against the philosophical mainstream descending from Frege and Russell to Quine, Davidson, (...) Dummett, McDowell, Evans, Putnam, Kripke and others, the authors demonstrate that discarding the notion of reference does not entail relativism or semantic nihilism. A provocative re-examination of the interrelations of language and social practice, this book will interest not only philosophers of language but also linguists, psycholinguists, students of communication and all those concerned with the nature and acquisition of human linguistic capacities. Abstract:During recent years, the principle and practice of employment-at-will have been under attack. While progress has been made in eroding the practice, the principle still governs the philosophical assumptions underlying employment practices in the United States, and, indeed, EAW has been promulgated as one of the ways to address economic ills in other countries. This paper will briefly review the major critiques of EAW. Given the failure of these arguments to erode the underpinnings of EAW, we shall suggest new avenues (...) for approaching employment issues to achieve the desirable goal of employee dignity and respect. Multi-stakeholder initiatives (MSI), defined as global institutions involving mainly corporations and civil society organizations, are one type of regulatory mechanism that tries to fill this gap by issuing soft law regulation. This conceptual paper examines the conditions of a legitimate transfer of regulatory power from traditional democratic nation-state processes to private regulatory schemes, such as MSIs. Democratic legitimacy is (...) typically concerned with input legitimacy (rule credibility, or the extent to which the regulations are perceived as justified) and output legitimacy (rule effectiveness, or the extent to which the rules effectively solve the issues). In this study, we identify MSI input legitimacy criteria (inclusion, procedural fairness, consensual orientation, and transparency) and those of MSI output legitimacy (rule coverage, efficacy, and enforcement), and discuss their implications for MSI democratic legitimacy. Modern society is challenged by a loss of efficiency in national governance systems values, and lifestyles. Corporate social responsibility (CSR) discourse builds upon a conception of organizational legitimacy that does not appropriately reflect these changes. The problems arise from the a-political role of the corporation in the concepts of cognitive and pragmatic legitimacy, which are based on compliance to national law and on relatively homogeneous and stable societal expectations on the one hand and widely accepted rhetoric assuming that all members (...) of society benefit from capitalist production on the other. We therefore propose a fundamental shift to moral legitimacy, from an output and power oriented approach to an input related and discursive concept of legitimacy. This shift creates a new basis of legitimacy and involves organizations in processes of active justification vis-à-vis society rather than simply responding to the demands of powerful groups. We consider this a step towards the politicization of the corporation and attempt to re-embed the debate on corporate legitimacy into its broader context of political theory, while reflecting the recent turn from a liberal to a deliberative concept of democracy. In Frege's Conception of Logic Patricia A. Blanchette explores the relationship between Gottlob Frege's understanding of conceptual analysis and his understanding of logic.

Human embryonic stem cell research can bring about major biomedical breakthroughs and thus contribute enormously to human welfare, yet it raises serious moral problems because it involves using human embryos for experiment. The “moral status of the human embryo” remains the core of such debates. Three different positions regarding the moral status of the human embryo can be categorised: the “all” position, the “none” position, and the “gradualist” position.The author proposes that the “gradualist” position is more plausible than the other (...) two positions. Confucius’s moral principle of jen, which proposes a unique theory of “love of gradation”, and the principle of yi, which advocates “due treatment for persons”, are then explored. The author then argues that our moral obligations to do good to other living organisms, persons, and our families are different.Putting together the “gradualist” position on the human embryo, and Confucius’s theories of “love of gradation” and “due treatment for persons”, the author concludes that the early embryo has less ethical significance than the later fetus and adult human. The moral obligation we have toward persons is clearer and stronger than that which we have toward human embryos. Embryo research is justifiable if it brings enormous welfare to human persons that cannot be otherwise achieved. The “love of gradation” requires us, however, to extend love and respect towards other entities according to their different status. We should therefore be very cautious in using human embryos for research, acknowledging the gradualist nature of their moral status. (shrink)

Patricia Crone's _God's Rule_ is a fundamental reconstruction and analysis of Islamic political thought focusing on its intellectual development during the six centuries from the rise of Islam to the Mongol invasions. Based on a wide variety of primary sources--including some not previously considered from the point of view of political thought--this is the first book to examine the medieval Muslim answers to questions crucial to any Western understanding of Middle Eastern politics today, such as why states are necessary, (...) what functions they are meant to fulfill, and whether or why they must be based on religious law. The character of Muslim political thought differs fundamentally from its counterpart in the West. The Christian West started with the conviction that truth (both cognitive and moral) and political power belonged to separate spheres. Ultimately, both power and truth originated with God, but they had distinct historical trajectories and regulated different aspects of life. The Muslims started with the opposite conviction: truth and power appeared at the same time in history and regulated the same aspects of life. In medieval Europe, the disagreement over the relationship between religious authority and political power took the form of a protracted controversy regarding the roles of church and state. In the medieval Middle East, religious authority and political power were embedded in a single, divinely sanctioned Islamic community--a congregation and state made one. The disagreement, therefore, took the form of a protracted controversy over the nature and function of the leadership of Islam itself. Crone makes Islamic political thought accessible by relating it to the contexts in which it was formulated, analyzing it in terms familiar to today's reader, and, where possible, comparing it with medieval European and modern political thought. By examining the ideological point of departure for medieval Islamic political thought, Crone provides an invaluable foundation for a better understanding of contemporary Middle Eastern politics and current world events. Many models of (un)ethical decision making assume that people decide rationally and are in principle able to evaluate their decisions from a moral point of view. However, people might behave unethically without being aware of it. They are ethically blind. Adopting a sensemaking approach, we argue that ethical blindness results from a complex interplay between individual sensemaking activities and context factors.

Biopolitics and Utopia explores the intersection of biopolitics and utopian thought. As an interdisciplinary work, it addresses many salient biopolitical issues (state and medical interventions in the body, fears over scientific progress, resistance to state biopower, and ethical concerns), while also engaging in the utopian drive behind biopolitical efforts. The book is structured into four main sections: Actions, Speculations, Reactions, and Reflections. The chapters in Actions examine the practices of direct, medical intervention to 'normalize' citizens' bodies. The next section, Speculations, (...) approaches the intersection of utopia and biopolitics through a literary lens, reviewing science fiction texts as expressions of cultural and social fears about scientific progress. Reactions outlines potential acts of resistance in the face of biopower. Current treatments of practical rationality understand reasons as considerations counting in favor of or against some practical option, treating the positive and the negative case as symmetrical. Typically the focus is on examples of positive reasons. However, I want to shift the spotlight to negative reasons, as making a tighter or more direct link to rationality — and ultimately to morality, which is what much of the current interest in reasons is meant to clarify. Recognizing a positive/negative asymmetry in normative (...) force will let us reconcile the view of moral or other requirements as based on reasons with the denial that reasons as such, even all-thingsconsidered reasons, yield requirements — or as I like to put it, rationally compel. The debate about the appropriate standards for upstream corporate social responsibility of multinational corporations has been on the public and academic agenda for some three decades. The debate originally focused narrowly on “contract responsibility” of MNCs for monitoring of upstream contractors for “sweatshop” working conditions violating employee rights. The authors argue that the MNC upstream responsibility debate has shifted qualitatively over time to “full producer responsibility” involving an expansion from “contract responsibility” in three distinct dimensions. First, there is an expansion (...) of scope from working conditions to human rights and social and environmental impacts broadly defined. Second, there is expansion in depth of this broader responsibility to the whole upstream supply chain without regard to contracting status. Upstream responsibility now includes all suppliers, including direct contractors and the chain of suppliers to such contractors. Tobacco companies have started to position themselves as good corporate citizens. The effort towards CSR engagement in the tobacco industry is not only heavily criticized by anti-tobacco NGOs. Some opponents such as the the World Health Organization have even categorically questioned the possibility of social responsibility in the tobacco industry. The paper will demonstrate that the deep distrust towards tobacco companies is linked to the lethal character of their products and the dubious behavior of their representatives in recent decades. As (...) a result, tobacco companies are not in the CSR business in the strict sense. Key aspects of mainstream CSR theory and practice such as corporate philanthropy, stakeholder collaboration, CSR reporting and self-regulation, are demonstrated to be ineffective or even counterproductive in the tobacco industry. Building upon the terminology used in the leadership literature, the paper proposes to differentiate between transactional and transformational CSR arguing that tobacco companies can only operate on a transactional level. As a consequence, corporate responsibility in the tobacco industry is based upon a much thinner approach to CSR and has to be conceptualized with a focus on transactional integrity across the tobacco supply chain. Despite considerable growth in understanding of various aspects of sporting and exercise embodiment over the last decade, in-depth investigations of embodied affectual experiences in running remain limited. Furthermore, within the corpus of literature investigating pleasure and the hedonic dimension in running, much of this research has focused on experiences of pleasure in relation to performance and achievement, or on specific affective states, such as enjoyment, derived after completing a run. We directly address this gap in the qualitative literature on sporting (...) and exercise embodiment by contributing novel insights on the mind-body pleasures of running via focusing analytic attention towards the pleasures recalled by runners as experienced during positive, rewarding running experiences. Applying conceptual insights drawn from sociological phenomenology, we analyse data from an in-depth, event-focused interview study with distance runners who reported positive, rewarding experiences in recent recreational runs. Through reflexive thematic analysis, we present findings in relation to three themes: (1) ‘running feels like it should’; (2) sensory engagements; and (3) time out. The study contributes fresh perspectives, both conceptually and in relation to data-collection approach, to a small literature on the lived experience of pleasure in sport, exercise and physical cultures. I know because I have edited it myself—that's a sort of pun, in which the words "the rhetorical tradition" refer both to a book and to the cultural phenomenon the book represents. Bruce Herzberg and I (2001) have co-edited an anthology entitled The Rhetorical Tradition: (...) Readings from Classical Times to the Present. That project also involved editing the tradition itself, because, at least since the days of Isidore of Seville, it is through inclusions and exclusions in anthologies such as ours that the rhetorical tradition is established, grows, and changes. Anthologies seem always to have played a large role in the definition of the rhetorical tradition because the accessibility of texts has so often been an issue in the study of rhetoric, whether transmission problems have been caused by the dissipation of classical learning at the end of the Roman period or are caused by the vagaries of print publication today. Then and now, the changing shape of the tradition may be discerned from the tables of contents of anthologies, a circumstance that has become especially evident to me now that we have had the opportunity to edit our volume twice. The tables of contents of the first edition, appearing in 1990, and the second, in 2001, show both some enduring similarities and some interesting differences.It is important to remember that what we inherit as the "rhetorical tradition," for blessing or curse, comprises at least three modalities: texts deemed worthy of rhetorical study, methods of analyzing those texts, and methods of teaching rhetoric according to precepts and principles derived from those texts. Such a description of our cultural legacy would seem to put texts at the center of the tradition, and indeed, anthologies focus our attention on the rhetorical tradition as a set of texts. Tables of contents organized chronologically suggest a neat progression of supposedly major works marching through the centuries, but why those particular works? In [End Page 109] the study of rhetoric as in the study of imaginative literature, scholars now realize that these supposedly inevitable textual monuments to an unbroken and progressively more sophisticated discipline are in fact quarried from among the masses of material each era produces by traditions, that is, methodological and pedagogical traditions, in how to study rhetoric. Although the tradition appears to be text-based, how we wish to analyze verbal productions and how we prefer to teach the art of producing them govern our choices of rhetorical texts to preserve, elevate, or delete. And modern histories of rhetoric have shown that the preferences governing these choices arise out of complex cultural factors relating to gender, race, social class, national identity, and more.Once upon a time, these choices were dominated by the preferences of socially privileged men who saw Western culture as the best in the world, and that culture itself as springing primarily from Greek and Roman roots. As Walter Ong (1981) has explained in Fighting for Life, these men believed that education in rhetoric must be for men only and that boys must be introduced to it via agonistic competition. From these assumptions sprang buttresses for what we might call the "traditional tradition" in the study of rhetoric, a progression of texts written by Plato, Aristotle, Cicero, Quintilian, Augustine, Erasmus, Bacon, Blair, and so on. This kind of study of rhetoric required extensive education, first, in Latin and Greek, often inculcated with the aid of corporal punishment, as Ong describes, and it persisted well into the twentieth century (though, one trusts, with much less flogging—that went out with co-education, as Ong explains). For example, until 1936, Greek was a graduation requirement at the Jesuit college where I teach, the College of the Holy Cross, and Latin was not dropped as a graduation requirement there until 1959 (the college was still all male, but the rationale for dropping the requirement appears to have centered upon the need to make room in the curriculum for pre-professional studies). Progress in the neurosciences is profoundly changing our conception of ourselves. Contrary to time-honored intuition, the mind turns out to be a complex of brain functions. And contrary to the wishful thinking of some philosophers, there is no stemming the revolutionary impact that brain research will have on our understanding of how the mind works. Brain-Wise is the sequel to Patricia Smith Churchland's Neurophilosophy, the book that launched a subfield. ABSTRACT:Partnerships between companies and NGOs have received considerable attention in CSR in the past years. However, the role of NGO legitimacy in such partnerships has thus far been neglected. We argue that NGOs assume a status as special stakeholders of corporations which act on behalf of the common good. This role requires a particular focus on their moral legitimacy. We introduce a conceptual framework for analysing the moral legitimacy of NGOs along three dimensions, building on the theory of deliberative democracy. (...)
